APPLICATION SURVEYS (ADVERSE POSSESSION ETC)
The results of a Title Re-establishment Survey may determine that a section of occupation (fence or building etc.) may differ significantly from the title plan dimensions attached to your Certificate of Title.
Dependant on the position and age of the occupation it may arise that you have gained possessory rights over that section of enclosed land not being part of your Certificate of Title.
An Application Survey is the formal process of acquiring a section of land adjacent to but not within your own Certificate of Title, which has been occupied by you for a period of no less than 15 years via Adverse Possession.
Extensive surveys combined with a detailed Licensed Surveyors Report etc. are required for adverse possesion applications.
The formal application to Land Victoria is generally handled in conjuction with a solicitor with experience in adverse possession applications.
